Terms and Conditions of Rental

1. Identification and Scope

These Terms govern the booking of the property known as Casa Battagliola (the "Property"), offered for short-term holiday rental by:

The Property accommodates a maximum of 18 guests across 9 bedrooms. Booking implies full and unreserved acceptance of these Terms.

2. Booking Process

A booking is made through casabattagliola.com. A reservation becomes firm and final only upon (i) the Owner's confirmation and (ii) receipt of the deposit defined in Article 4. The person making the booking must be over 18 and is responsible for all members of their party.

3. Prices and Inclusions

Rates are per week, for the exclusive use of the entire Property for up to 18 guests:

The rate includes: end-of-stay cleaning, laundry and linen, tourist tax, exclusive use of the whole Property, and a house attendant available 3 hours per day.

Minimum stay: 5 nights, except during early & late summer and peak summer, where a 7-night minimum applies.

4. Payment Terms

  • A deposit of 30% of the total price is payable to confirm the booking.
  • The balance is payable 60 days before the arrival date.
  • Payment is made by bank transfer.

5. Security Deposit

A refundable security deposit of €5,000 is required on arrival, taken by credit-card pre-authorisation through our deposit provider Tyllt (tyllt.com), together with a copy of a valid identity document. It is released after departure, less the cost of any damage, breakage, missing items, or additional cleaning.

6. Cancellation and Modification

By the guest (must be made in writing; the date of receipt prevails):

  • More than 90 days before arrival: the deposit is refunded.
  • Between 60 and 30 days before arrival: 50% of the total amount paid is retained and non-refundable.
  • Less than 30 days before arrival: 100% of the total amount paid is retained and non-refundable.

By the Owner: in the exceptional event the Owner must cancel, all sums paid are refunded in full, to the exclusion of any further compensation.

The Owner strongly recommends that guests take out cancellation insurance.

7. No Right of Withdrawal

In accordance with Article L221-28, 12° of the French Consumer Code, the 14-day right of withdrawal applicable to distance contracts does not apply to accommodation provided for a specified period. Bookings are firm upon confirmation, subject solely to the cancellation terms in Article 6.

8. Arrival and Departure

  • Check-in: from 5:00 PM
  • Check-out: by 10:00 AM

An inventory and condition check may be carried out on arrival and departure. Keys are handed over subject to full payment.

9. Occupancy and Use of the Property

  • The Property is reserved for the registered guests, up to a maximum of 18 persons. Parties and private celebrations among the registered guests are permitted. The admission of any person beyond the 18 guests covered by the booking requires the Owner's prior written agreement. Any unauthorised exceeding of this limit entitles the Owner to refuse access or terminate the stay without refund.
  • Pets are not permitted.
  • Smoking is not permitted indoors. Outdoors, guests must use the ashtrays provided and exercise the utmost caution given the high wildfire risk in the region.
  • The Property must be used peaceably and for residential, non-commercial purposes.

10. Guest Obligations

The guest agrees to use the Property and its equipment with care, to leave it clean and tidy, and to report any damage. Any deterioration is the guest's responsibility and may be deducted from the security deposit.

11. Owner Obligations

The Owner undertakes to make the Property available in conformity with its description, in good condition and clean, with all equipment in working order.

12. Liability and Insurance

The Owner declines all liability for theft or loss of personal belongings, or for any incident arising from misuse of the Property. Guests must hold civil liability insurance covering the rental period.

13. Personal Data

Personal data is processed in accordance with our Privacy Policy.

14. Complaints and Consumer Mediation

Any complaint should first be addressed to the Owner at casabattagliola@gmail.com

These Terms are governed by French law. Any dispute falls under the jurisdiction of the competent French courts.
